Timba and Company Denied Bail

Citizens Coalition for Change activists and their leader Jameson Timba have been denied bail by Justice Munamato Mutevedzi.

Judge Mutevedzi ruled that there was no reason to depart from the lower court’s ruling.

However, the judge released a minor who had been incarcerated for a month on free bail.

“After considering everything, I find no misdirection in the court’s overall assessment of the issues,” ruled Mutevedzi.

“The only appellant for whom the appeal can succeed is Maxwell Sande because of his age,” Mutevedzi stated.

Before the High Court, Timba’s lawyers argued that magistrate Ruth Moyo erred in denying bail.

“Accused 1 (Timba) is not liable for the offense only because people gathered at his house,” Bamu argued.

“That did not make him part of the gathering; the court should have distinguished his circumstances,” Bamu added.

“It is clear that the appellants were arrested at different places,” Bamu continued.

“The police did not ascertain the purpose of the gathering,” Bamu noted.

Lawyer Webster Jiti echoed the same sentiments but the court did not find favor with their arguments.
