In politics, the most dangerous job is not that of the opponent, but that of the loyal draftsman asked to do the dirty work.
For weeks, the corridors of power have whispered about the “Ziyambi Draft” the proposed amendments to the ZANU PF Constitution that sought to separate the Party Presidency from the State Presidency.
The narrative, carefully curated and leaked, is that Secretary for Legal Affairs, Hon. Ziyambi Ziyambi, went rogue; that he attempted an institutional coup against his principal, President E.D. Mnangagwa.
That narrative is convenient but is also false.
Convenient Narrative
A schooled reading of the events shows that Hon. Ziyambi is not the architect of a plot, but the victim of one that went spectacularly awry.
Consider the sequence.
In early 2026, the imperative from the very top was clear: Act No. 6 of 2026 had to be given life within the Party Constitution.
The President needed a legal bridge that would extend his tenure to 2030, shifting from a direct popular mandate to a parliamentary election.
This was not Ziyambi’s idea but an instruction from the First Secretary himself.
As Secretary for Legal Affairs, Ziyambi was ordered to draft the legal mechanism and he did what any diligent lawyer does.
He looked at comparative models, where a ruling party’s leader is distinct from the Head of State and where a Secretary General holds executive authority.
Then he produced a technically competent, if politically naive, draft that mirrored models in South Africa and China.
The fatal clauses, Section 2.1 (a) and (b) separating the presidencies, Section 3.1 asserting Party supremacy over State office bearers, and Section 7 creating a powerful Directorate under the Secretary General were not innovations of a lone wolf.
Unravelling The Principal’s Problem
They were working options in a high-stakes brainstorm to solve one problem: How do you legally justify keeping ED as Party President beyond 2028, while creating a new route for him to remain State President until 2030 via Parliament?
The problem was that the draft created a storm before it was sanitized.
In the brutal logic of ZANU PF politics, such a draft that is unpopular must be disowned.
President Mnangagwa, a master of political distance, did what he has always done.
He allowed the Politburo to be aborted, allowed the blame to settle squarely on his most loyal legal cadre, and preserved his own image as the aggrieved First Secretary who was never consulted.
Ziyambi, who tabled the document in good faith on the explicit understanding that he was executing the 2030 agenda, now finds himself branded treasonous.
An Innocent Victim
He is now accused of creating a centre of power above the President, when in fact he was trying to create a legal throne for the President to sit on until 2030.
This is the anatomy of a classic ED maneuver.
The principal orders a sensitive legal assignment and the subordinate executes it with legal skullduggery.
The proposal proves toxic to the provinces and the security establishment, and the subordinate is sacrificed to appease the base.
Hon. Ziyambi did not attempt to make the State President disciplinable by the Party.
He attempted to make the Party’s control over Parliament absolute, so that Parliament could never defy the Party and elect someone other than ED.
He did not attempt to empower the Secretary General as a Prime Minister but to build a bureaucratic machine that would manage the 2030 transition while the President remained above the fray.
Thus, it was not a coup but he was building a lifeboat for his boss, and he has now been thrown overboard from it.
The real question is not what Ziyambi wrote but who ordered him to write it, and why that person is now silent while his lawyer is being burned at the stake.
